Canada is a land of opportunities that welcome immigrants from all across the globe to study, work and settle in this fast growing economy. Not only the country provides individuals wanting to make a mark here, wonderful scope of growth, it is also welcoming towards the dependents of those individuals as well.

A dependent visa is a way of bringing your spouse, partner or your children to Canada, provided the individual applying for the visa is able to meet the set criteria. Whether you are studying, working or living as a Permanent Resident of Canada, you can apply for a dependent visa to get your family to stay with you.

WHO ALL YOU CAN SPONSOR –

  • Biological children, below 22 years of age.
  • A child adopted by the sponsor outside of Canada as a Canadian citizen or permanent resident living in Canada.
  • A child sponsor intends to adopt in Canada.
  • Sponsor’s brother or sister, nephew/ niece, grandson/ granddaughter, if they are an orphan and, under 18 years of age who do not have a spouse, common-law partner, or conjugal partner.
  • Any person who has family ties with the sponsor if they do not have a spouse, common-law partner, conjugal partner, son, daughter, mother, father, brother, sister, grandfather, grandmother, uncle, aunt, niece or nephew.
  • Your spouse, common-law partner, or conjugal partner.
  • Your parents or grandparents

DEPENDENT VISA SPONSORSHIP CRITERIA (CHILDREN) – 

  • You can sponsor dependent children under 22 years of age, who do not have a spouse, common-law partner, or conjugal partner.
  • The dependent child must be the biological child of the parent or the adopted child of the parent to be eligible for dependent visa.
  • The dependent child must be financially dependent on the parent and it should be proved.
  • The dependent child is not able to financially support him/herself due to a physical/ mental condition. Children aged 22 and above, who have been depending financially on their parents since  before the age of 22 are also considered dependent
  • You must provide proof of your relationship to your dependent children.
  • Children who are being sponsored will need to undergo a criminal and medical examination. Dependent children who have a criminal record or a contagious medical condition may be prevented from entering Canada.
  • The medical examination must be conducted by a physician who is approved by the Canadian government

DEPENDENT VISA SPONSORSHIP CRITERIA (SPOUSE / PARTNER) – 

  • The dependent spouse / partner may be allowed to work in Canada, if they are eligible for obtaining work permit. The decision to allow the dependent spouse/ partner to work is usually based on the nature of the visa which the sponsor of the dependent is holding in Canada.
    1. The dependent of the visa holder is eligible for work permit If, the job of the sponsor is listed under NOC 0, A or B.
    2. Primary applicants employed in an occupation that requires less formal training than their spouse will be able to obtain a work permit through the active pilot project.
  • Visa holders who are dependents and have an open work permit will enjoy the freedom to work in any position with any employers and will not be required to obtain an LMO (Labor Market Opinion).
  • The depending visa holders will need to undergo a police verification and medical examination. Dependents that have a criminal record or a contagious medical condition may be prevented from entering Canada.
  • The medical examination must be conducted by a physician who is approved by the Canadian government
  • The depending visa holder must apply for the work permit and can apply even before entering the Canada.
  • If the primary applicant holds a Post-Graduation Work Permit, then the spouse/ partner is required to add a copy of his/ her work permit to the application and attach supporting documents for the same.

DEPENDENT VISA ELIGIBILITY CRITERIA (SPONSOR) – 

  • The sponsor to the dependent visa should be minimum 18 years of age.
  • The sponsor must prove that he/ she is capable of supporting the spouse/ partner and dependent children in terms of finances.
  • The sponsor has to meet certain income criteria to prove his/ her ability to sponsor.
  • The dependent spouse if applying should be married to the sponsor in a manner that is valid under the legal system of his/ her country, where the marriage took place as well as under Canadian law.

SUPER VISA – 

Super visa allows an individual to sponsor his/ her parents and grandparents to come and live in Canada with them. It is a multiple entry visa and your dependent parent / grandparent can stay in Canada up to 2 years at a time. It is valid for 10 years.

ELIGIBILITY CRITERIA –

  • The sponsoring child/ grandchild of the applicant should earn a minimum level of income to be able to support their dependents during their stay in Canada.
  • The applicant for Super Visa should submit a letter from his child/ grandchild mentioning that he/ she is willing to support the parent or grandparent during their stay in Canada.
  • The applicant for Super Visa should be covered with medical insurance for a minimum period of one year.
  • The applicant is required to undergo a medical exam and be declared medically healthy and fit, for travelling Immigration to Canada
